An unregistered mark gives almost nothing to enforce in the UAE. The system rewards the party that registered first, not the party that used the brand first, and the gap between those two is where most disputes start. Register, then enforce. IP lawyers in the UAE spend more time fixing late or incomplete registration than arguing infringement, because the registration decides the strength of the claim.
Registration
We file and prosecute trademarks under Federal Decree-Law No. 36 of 2021, including through the Madrid Protocol for international portfolios, and we handle patents and industrial designs under Federal Decree-Law No. 11 of 2021 and copyright under Federal Decree-Law No. 38 of 2021. The classification and ownership decisions made at filing decide what the right protects later.
Enforcement
We act on infringement, counterfeiting and passing off through civil claims, criminal complaints and Ministry of Economy enforcement, and on customs recordal to stop counterfeit goods at the border. Enforcement works when the registration is clean and the evidence of use is in order before the action starts.
Commercial IP
We draft and negotiate licensing, franchising, assignment and technology-transfer agreements, and the IP terms inside wider commercial contracts. The value of a brand or a technology is realised through these agreements, and the wording decides who owns what when the relationship ends.
